Binance Faces SEC Lawsuit Over Unregistered Securities, Court Moves Forward on Some Claims

The United States Securities and Exchange Commission (SEC) has now taken legal action against Binance, one of the world’s most popular cryptocurrency exchanges. Binance has been accused by the SEC of violating federal securities laws by offering to sell unregistered securities and conducting business in the United States in an improper manner. There are a number of allegations made against Binance in this legal proceeding. These allegations include allegations regarding the company’s staking program and the subsequent sale of BNB tokens. Initial Coin Offeringand violating anti-fraud regulations. Some claims were allowed to proceed, but others were dismissed by the courts that heard them.

Allegations Allowed to Proceed: Binance’s Staking Program The court has decided to proceed with allegations related to Binance’s staking program, which allows participants to accumulate incentives by holding certain cryptocurrencies.
As the initial coin offering of the cryptocurrency proceeds, the claims related to the BNB token sale will also proceed. In this regard, the court will conduct further investigation into the claims raised by the SEC.

Anti-Fraud Violations: The court granted an extension of the claim related to anti-fraud violations committed by Binance, which appears to indicate that the SEC has provided sufficient evidence to support these allegations.

“Controller” allegations: The court also decided to advance the SEC’s claim that Binance’s former CEO Changpeng “CZ” Zhao assumed a “controller” role within the company.

Claims related to BNB secondary market sales dismissed by court The court ruled that claims related to BNB secondary market sales were dismissed. Claims filed by the Securities and Exchange Commission (SEC) related to the sale of BNB tokens on the secondary market failed to meet the conditions set by the court.
Binance USD (BUSD) Sale: The court ruled that all claims related to the sale of Binance USD (BUSD), a stablecoin issued by Binance, were dismissed.

The court’s decision to continue allowing numerous claims despite several having been dismissed is noteworthy. Specifically, this suggests that the Securities and Exchange Commission (SEC) has made a compelling case against Binance, raising concerns about the exchange’s securities compliance. The court set a hearing for July 9 to conduct a more in-depth investigation into the claims and gather additional evidence.
