Binance founder Changpeng “CZ” Zhao has been ordered by a federal judge to remain in the United States until his sentencing in February. The judge cited concerns that Zhao would be a flight risk if he returned to the United Arab Emirates. Zhao faces a possible 18 months in prison after pleading guilty to money laundering charges on November 21. The judge noted that the defendant’s significant overseas assets and property, as well as his family living in the UAE, were contributing factors to his flight risk. Zhao’s guilty plea is part of Binance’s settlement with U.S. regulators that involved a $4.3 billion fine and admission to operating an unlicensed money transfer business.
Flight risk issues and sentencing date
Seattle District Court Judge Richard Jones ordered Zhao on Dec. 7 to remain in the U.S. until sentencing on Feb. 23, 2024. The judge agreed with federal prosecutors’ argument that Zhao had ties to the UAE and not the United States. He poses a significant flight risk. The court emphasized that Mr. Zhao failed to demonstrate through clear and convincing evidence that he was unlikely to flee even if he returned to the UAE. Zhao’s guilty plea could result in an 18-month prison sentence, until which time he has agreed not to appeal any sentence.
Wealth and family relationships as factors
Judge Jones highlighted Zhao’s considerable wealth and overseas holdings, as well as his family residing in the UAE, as key considerations in the decision. The judge noted that Zhao’s bond, set at $175 million, appears to be comprised primarily of assets beyond the government’s reach. Acknowledging that the bail conditions allow Zhao to travel freely within the United States and visit family, the judge viewed these conditions as a minimal imposition on the defendant’s freedom.
Binance Settlement and CEO Change
Last November, Binance and Zhao agreed with U.S. regulators to pay a $4.3 billion fine for operating an unlicensed money transfer business and violating bank secrecy laws. As part of the settlement, Zhao stepped down as CEO of Binance. The regulatory action against Binance and its founder highlights the challenges major cryptocurrency exchanges face in navigating the regulatory environment and complying with financial regulations.
