Regs update
SEC CRYPTO Task Force said. In the published statement, the Hester Peirce Commissioner revealed the priority for the upcoming task force work.
Here our analysis focuses on how this work affects Vault12.
The first thing to note is that the regulations or laws have not changed (banks can exercise encryption custody, except to withdraw the controversial SEC Bulletin SAB 121). Until the SEC policy is actually changed, a new bill is written and submitted to Congress, or a lawsuit is completed, everything that occurs is simply no direction and no obligations. Therefore, the company should be careful not to get lost in the gray area and not to create potentially legal risks.
Let’s take a look at three main items.
- Security status: This is the basic policy item that requires explanation, and everything else will cling to the definition used here. Is it an issue of encryption tokens in software developer utility or securities?
- Coin and token products. What happens if the token was issued as security due to abundant attention (and lack of clarity), but it is actually used as a utility token? This was the theme of the “Safe Harbor 2.0” initiative of the former administration’s Peirce Commissioner.
- Special Purpose Broker Dealer: Under the last management, the definition of “broker-dealer” has been expanded, leading to basic conflicts such as centralized exchanges, distributed exchange (DEX), and smart contracts. And it is an impossible and active legal process. These lawsuits should be resolved so that the industry can proceed through financial product innovation and disclosure.
If these items are organized, the encryption company can freely carry out business and trade tokens.
