November 15th Judge upholds dismissal of meritless lawsuit against Tether and Bitfinex, plaintiffs dismiss appeal.

Following the order of Chief Judge Laura Taylor Swain of the U.S. District Court for the Southern District of New York denying Shawn Dolifka’s motion for leave to amend the meritless class action lawsuit he filed against the companies Tether and Bitfinex, Dolifka decided not to appeal the decision. Judge Swain’s dismissal of the lawsuit and ruling in favor of the Tether and Bitfinex companies are now final in all respects.
Unlike Dolifka’s poor decision to file the lawsuit in the first place, his decision to waive his right to appeal was the right one. His claim was completely without merit and further litigation would not have resulted in Dolifka or his attorneys realizing anything, monetary or otherwise. As we have said many times in the future, Bitfinex and Tether will never fall victim to shameless litigation funding.
